That isn't the issue. The issue is whether the legislation violates the Constitution, which takes a major supermajority to amend. That is the protection for the people, a mere majority can't change the basic structure.
We vote in our reps but our reps each take an oath to defend the Constitution from all enemies, foreign and domestic.

Congress people are supposed to do what their constituents want. You know the breaks that Senators and Representatives go on? You think those are just for vacations? Those have always been around for this reason.

Ok so a State like Alaska is sitting on billions of barrels of oil , how is it the right of the Federal Government to deny Alaskans their own oil ?
I'm aware of what the 10th Amendment says, and that we are in a Republic. My point is that has the far reaching effect on the economy as universal health care should not be decided on by the federal government. It should require a constitutional amendment, which requires it to be ratified by 3/4 of the states. It's too important of a decision to be left to the federal government alone.

The health care bill WILL be interstate commerce by any definition you use.
States will not have the power to excuse themselves.
Besides that,,, the 10th amendment itself grants the INDIVIDUAL the same rights as the States.
Therefore if a citizen of ANY state wants to participate in a federal healthcare program, they have that Constitutional right.
Those who bandy the Constitution around in their rants should also take the time to read Article 1, Section 8:
"The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States."
Welfare is defined as "health, well-being, happiness". That means Congress has the right to levy taxes to provide for the health care of its citizens. It doesn't have to be passed on to the states. End of debate.
