If I hit someone with a baseball bat that is a crime regardless of the person's gender, sexuality, race, etc. If someone calls me a name that is not a crime unless they physically harm me. Why should someone get special treatment just because they are gay that is wrong.

Freedom of speech and hate crimes are two different things. Calling people names is not a hate crime and is protected under the first amendment. Hate crimes only tend to mean violence against a person or group of people.
There shouldn't be such thing as hate speech, it's only free speech.
