Grant V Southwest trains (1998) the EU refused to extend equal pay to cover discrimination because of sexual orientation. The EU stated that members are not in agreement about the stability of relationships of people of the same sex. The court is however moving away from this in recent times. In Safet Eyup V Landesge- Schaftsstelle des Arbeitsmarktservice Vorarlberg (2000) the court decided that the time spent together as a couple as well as a married couple must be taken in to account. Although this case was about heterosexual couples it was a step forward for same sex couples as well.
